1.1 These Terms of Use ("Terms") constitute a legally binding agreement between you and us, the developer of Gotube Pro (the "App").
1.2 By downloading, installing, accessing, or using the App in any manner, you agree to be bound by these Terms.
1.3 If you do not agree to these Terms, you must not download, install, or use the App.
1.4 Your use of the App is also subject to Apple's App Store Terms of Service, which govern your access to and use of the App Store and any applications downloaded therefrom.
1.5 These Terms apply to all users of the App, regardless of whether you are a first-time visitor or a continuing user.
2.1 The App is not directed to children under the age of 12. By using the App, you represent and warrant that you are at least 12 years of age.
2.2 If you are under the age of 12, you represent that you have obtained the consent of your parent or legal guardian to use the App and agree to these Terms.
2.3 We reserve the right to refuse access to the App to any user at any time, in our sole discretion.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.You acknowledge that the App is licensed, not sold, to you, and that we retain all ownership rights in the App not expressly granted to you under this license.
4.1 To enable the meditation music playback and video-to-audio conversion features, the App requires permission to read local files on your device. By granting this permission, you authorize the App to access only those files you explicitly select for these functions.
4.2 We do not upload, transmit, store, or otherwise process any of your local files on our servers. We do not access, read, or collect any files other than those you manually choose for the specific purposes of music playback during meditation or video-to-audio conversion. For information about how we and third-party SDKs collect and process data through the App, please refer to our Privacy Policy.
5.1 You agree to use the App only for lawful purposes and in accordance with these Terms.
5.2 You shall not reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent such restriction is expressly prohibited by applicable law.
5.3 You shall not modify, adapt, translate, or create derivative works based upon the App or any part thereof.
5.4 You shall not remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the App.
5.5 You shall not use the App for any unlawful, fraudulent, or malicious purpose, or in any way that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.
5.6 You shall not use the App to transmit any viruses, worms, malware, or other code of a destructive or harmful nature.
5.7 You shall not use the App in any manner that violates any applicable laws or regulations, including but not limited to copyright and intellectual property laws.
5.8 You shall not scrape, crawl, or use any automated means to access the App or collect any information from the App without our prior written consent.
6.1 We are deeply committed to the protection of minors and maintain a zero‑tolerance policy toward any form of child sexual exploitation or abuse.
6.2 You are strictly prohibited from using the App to create, upload, store, share, distribute, transmit, display, or otherwise make available any content that depicts, describes, promotes, or encourages child sexual abuse material, child pornography, or any form of sexual exploitation or endangerment of a minor.
6.3 This prohibition applies regardless of the format of such content, including photographs, videos, digital images, computer‑generated images, text, or any other media.
6.4 You are also prohibited from using the App to solicit, groom, or engage in any inappropriate or exploitative communication with a minor, or to facilitate any activity that would constitute a violation of applicable laws relating to the sexual exploitation of children.
6.5 If we become aware of any content or conduct that may involve child sexual exploitation or abuse, we will take immediate and appropriate action, which may include removing the offending content, terminating your access to the App, and reporting the matter to the relevant law enforcement authorities where applicable.
7.1 All content, features, and functionality of the App, including but not limited to the software, design, text, graphics, logos, icons, images, and the selection and arrangement thereof, are owned by us or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
7.2 The Gotube Pro name and any related logos are our trademarks and may not be used without our prior written permission. You are granted no right or license to use any of our intellectual property rights.
8.1 The App integrates third-party software development kits (SDKs), including but not limited to Google AdMob, Pangle, Vungle, Adjust, Firebase, and Kochava.
8.2 We do not control these third-party services and are not responsible for their content, accuracy, or data practices. Your interactions with any third-party advertisements or services are solely between you and the applicable third party, and we disclaim all liability in connection therewith.
9.1 We are committed to delivering a reliable and enjoyable experience through Gotube Pro, and we continuously invest time and effort into improving the App, fixing issues, and refining its features to serve you better.
9.2 However, we must acknowledge that no software is perfect, and the App operates within the inherent limitations of technology and the devices you use. Therefore, the App is provided on an "as is" and "as available" basis, and to the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement.
9.3 While we strive to keep the App running smoothly, we cannot guarantee that it will be uninterrupted, entirely error‑free, completely secure, or free from viruses or other harmful components, nor can we guarantee that any defects will always be corrected.
9.4 Similarly, any content, information, or services provided through the App are offered for your convenience, and we do not warrant their accuracy, reliability, or completeness.
9.5 By using the App, you understand and accept that you assume full responsibility and risk for your use.
To the maximum extent permitted by applicable law, in no event shall we, our affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, loss of data, loss of goodwill, or any other intangible losses, arising out of or in connection with your use or inability to use the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
11.1 You agree to indemnify, defend, and hold harmless us and our affiliates, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any rights of any third party.
11.2 We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.
12.1 These Terms shall remain in effect until terminated by either you or us.
You may terminate these Terms at any time by uninstalling and ceasing all use of the App.
12.2 We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including without limitation if you breach any provision of these Terms.
12.3 Upon termination, your license to use the App shall immediately cease, and you must uninstall the App and delete all copies thereof from your devices.
12.4 All provisions of these Terms that by their nature should survive termination, including without limitation intellectual property provisions, warranty disclaimers, liability limitations, and indemnification obligations, shall survive such termination.
13.1 We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms within the App, and the "Last Updated" date at the top of these Terms will be updated accordingly.
13.2 Your continued use of the App after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically to stay informed of any updates.
13.3 If you do not agree to any changes, you must stop using the App and uninstall it from your devices.
